Real Estate Litigation
Real estate litigation disputes in Ontario can take many forms. In one case, you may have purchased a house and later discovered defects that were not disclosed to you before the agreement was signed. In another case, one party breaches the agreement of purchase and sale for a property, and the other party has the right to sue or take other suitable legal action. These disputes are handled by real estate litigators when they are contested in the courts for resolution.
The buying, selling and leasing of property, both commercial and residential, are governed by the real estate and contract laws of Ontario. In a real estate transaction, all parties sign an agreement that sets out the terms and conditions. If one party does not honour their part of the contract, the other party has the right to sue to enforce the contract or to claim damages.
If a buyer refuses or fails to close a real estate purchase, the seller can normally keep the deposit and may also claim damages for any further loss, for example where the property later sells for less. If it is the seller who refuses to close, the buyer may claim their actual damages and, in some cases, ask the court to order the seller to complete the sale. Most civil claims in Ontario cannot be started more than two years after the claim was discovered, so it is important to get legal advice early.
